Administrative fine

The municipality keeps personal data about residents in the Personal Records Database (BRP). For example, a move, birth, marriage or divorce. You will notify the municipality of any changes to this. This is required by law. If you do not do this, you may be fined.

What do you need to know

If your details are incorrect in the BRP, you can be fined for this. The administrative fine may be imposed in accordance with the Basic Registration of Persons Act (Wet BRP), article 4.17.

We use your data in the BRP to be able to perform our tasks properly. For example to make a passport, identity card or driver's license. But also to know who can vote, who is entitled to housing benefit or for municipal taxes. It is important for the police, ambulance and fire brigade to know how many people live at an address and whether they are related. The correct data in the BRP is therefore important.

What do you have to do

You must adhere to these rules:

  • Moving from abroad: pass on within 5 days of arrival
  • Relocation to or within Hilversum: report within 4 weeks before or within 5 days after your move
  • Moving to another municipality within the Netherlands: notify the municipality where you are going to live within 4 weeks before or within 5 days after your move
  • Moving abroad (longer than 8 months): report from 5 days before your departure
  • Personal data have changed abroad (for example, married, had a child or death of a spouse): pass it on as soon as possible. A marriage, birth or death in the Netherlands is automatically entered in the BRP
  • mailing address at your address: you must ensure that the person who has a postal address with you receives the mail. If we ask you for information about the whereabouts of this person. Then you must provide this information
  • Questions about your data: we may ask you for more information about your data in the BRP or about that of your close relatives. This can also be documents. You must provide this information
  • Correct address in BRP: sometimes we suspect that your address in the BRP is incorrect. We may then ask you to prove whether your address is correct. You must provide this information

Objection

The municipality may not simply give you an administrative fine. If the municipality believes that you have not complied with the rules as described above, this must be apparent from the information the municipality has. That information must show that you have not followed these rules and that you are at fault. The imposed fine cannot be stopped or changed. Not even if you still pass on the changes.

If you have received an administrative fine, you can object to this. You must submit your objection to the Municipal Executive within 6 weeks. The municipality will investigate your objection and decide whether this is justified or not. If your objection is justified, the fine will be reversed. If your objection is not justified, the fine will remain. You can, however, appeal to the administrative court.
