What do you need to know
The Bibob Act is called the Act on the Promotion of Integrity Assessments by Public Administration in full. With this act, the municipality of Hilversum assesses whether there is a risk that:
- Benefits are derived from criminal activities such as money laundering
- Criminal acts are being committed
This law ensures that the municipality carefully examines the integrity of companies and individuals who work with the municipality.
When does the Bibob Act apply?
The municipality of Hilversum has described in its Bibob policy in which situations the Bibob Act applies.
- Hospitality industry, coffee shops and sex businesses (note: a Bibob investigation is always carried out for these applications)
- Events
- Environmental permit for construction
- Environmental permit
- Grants
- Real estate transactions
- Government contracts
Testing based on signals
The municipality can also start a Bibob investigation if there are signals that the applicant or his business environment may be involved in criminal acts. If the municipality receives signals of criminal acts, among other things, after granting a permit, an investigation of the Bibob Act can also follow.
What do you have to do
If your application is assessed against the Bibob Act, you must complete a Bibob form. This form states exactly which documents you must submit for the assessment. When assessing the received documents, the municipality may ask additional questions and request additional documents. If insufficient information has been provided, your application may be rejected.
In case of doubt about integrity, finances and/or the business relationship(s), the municipality can request advice from the National Bibob Office (LBB). A request for advice from the LBB has consequences for the processing period of the application. The outcome of the Bibob advice from the LBB is included in the decision-making process.
Outcomes
If the Bibob investigation shows that there is a risk that the municipality is facilitating criminal activities, the municipality can refuse the application for a permit, subsidy or order. The municipality can also decide not to enter into a real estate transaction. In addition, current permits or subsidies can be withdrawn, an awarded order can be reversed, or a real estate transaction can be terminated.
