Privacy statement Social Support Act 2015 (Wmo)

This privacy statement provides additional information about how Social Square handles your personal data when performing tasks within the Social Support Act. In addition, we explain to you what your rights are herein.

What do you need to know

The municipality is responsible for the implementation of the Social Support Act 2015 (Wmo 2015). This concerns support for the self-reliance and participation of the resident, social relief and sheltered housing. We work together with various organizations for social support. To make this possible, the municipality uses and shares personal data.

For support, to ensure that the resident's self-reliance and participation is increased, you can think of aids or care in the field of:

  • live
  • transport
  • domestic help
  • guidance and day care

The condition is that the resident is not able to overcome his or her limitations with regard to independent living and/or participation in society with the aid of his social network.

Social shelter is intended for homeless people with psychosocial and/or safety problems, who need guidance in addition to shelter. In addition, there is temporary shelter for homeless people who have a connection with Hilversum.

Sheltered housing is intended for people from the age of 18 with (long-term) psychiatric and/or psychosocial problems. They cannot (yet) live completely independently and function within society. Sheltered housing offers them housing with supervision and guidance.

For what purposes do we use personal data

We use personal data to be able to grant, monitor and keep track of support from the Wmo 2015. This also includes monitoring the waiting lists.

We use personal data, among other things, if this is necessary for:

  • access to care
  • answering customer questions and recording contact moments
  • performing an intake
  • drawing up a roadmap
  • preparing and sending a decision
  • arranging payments of a personal budget
  • investigation into the lawful use of an allocated personal budget
  • determine and have a personal contribution paid if applicable
  • determine whether the municipality is financially responsible for the care and support
  • reimbursement of costs to healthcare providers for care provided

From whom do we collect personal data

For the services in the context of social support, we process - insofar as necessary - personal data of, among others, the following persons:

  • Applicant
  • Housemates
  • Contact
  • Informal carer(s)
  • authoritative
  • Trustee or legal representative

What data do we use

We use different categories of personal data. For example, we use the name and address, or data about the health of the resident. We can also use this information from housemates or informal carers if this is important for the support request.  

Chapter 5 of the Wmo specifies from whom and what personal data we collect and use. These include:

  • Name and address details
  • Date of Birth
  • BSN
  • contact details such as telephone number and e-mail address
  • contact details of the social network
  • data on self-reliance
  • information about the trajectory plan and the goals pursued
  • information about actions to be taken and facilities enjoyed
  • information about the healthcare provider(s) involved
  • criminal data if this is necessary for exercising supervision or taking measures to enforce legal regulations.
  • data on health if this is necessary to assess the need for care and support
  • Financial details
  • Participation problem
  • Living situation
  • Family composition

Basis

We only use (special) personal data if there is a basis for doing so.

On the basis of the law, the municipality has the task of organizing the system around social support. For example, we must ensure that adequate facilities can be deployed. We use personal data on the basis of this task. This is stipulated, among other things, in Chapter 5 of the Social Support Act 2015.

Who receives the personal data

If necessary, we share personal data. For example, we share data with the Social Insurance Bank (SVB) in the context of the payments of the personal budget. We share data with the Central Administration Office (CAK) in order to calculate the personal contributions of those involved. We also share personal data with healthcare providers and social service providers.

How long do we keep the personal data

We do not store personal data longer than necessary for the purposes described. We must keep data relating to the Wmo for at least 15 years. We also use the retention periods in accordance with the Archives Act 1995.

Change of this privacy statement

This is the privacy statement for the Social Square of the municipality of Hilversum. This privacy statement can be adapted to amended laws and regulations and/or to the way in which we process personal data. This version was drawn up on June 11, 2021.
