Privacy statement Municipal Debt Assistance Act (Wgs)

The municipality provides debt assistance to Hilversum residents who need support due to financial concerns. The real debt assistance is provided by the municipality itself or by other social service providers.
For the performance of this statutory task and for the improvement of the service, it is necessary to process personal data. This privacy statement provides additional information about how we handle your personal data. In addition, we explain to you what your rights are in this regard.

What do you need to know

There is additional information for the privacy of municipal debt assistance.

Early detection

Early identification aims to get in touch with Hilversummers with (imminent) problematic debts and to offer them help of their own accord. This is usually done through home visits. Early detection concerns people who are not yet in the picture of the municipality and who may not know that they can get help. If you do not want help, the reporting party will be informed about this and the regular collection procedure will often be initiated. The privacy rules of the relevant external party then apply.

For what purposes we use personal data

The municipality uses the personal data for various purposes. Where the data is only intended for general reporting (monitoring), the personal data is anonymised.
We use the personal data for, among other things:

  • assess financial situation and the cause thereof
  • implementation of budget management
  • debt counseling
  • monitoring debt assistance, such as throughput times, recidivism, result outflow, successful arrangements and number of clients spoken
  • conducting discussions with the Social Service Providers about the results of the debt counseling in order to jointly increase the quality of the debt counseling
  • collecting the number of Hilversum residents in debt assistance for the purpose of financial compensation to Social Service Providers
  • making management reports to improve and account for our policy;
  • customer satisfaction surveys
  • provision to the Ministry of Social Affairs and Employment for research, statistics and policy making with regard to the law

Specifically for early detection, we use personal data to:

  • Prevent evacuations of homes or disconnection of utilities
  • against payment arrears
  • recover payments and avoid costs
  • avoid problem debts

Which personal data we use

The debt counselors collect and use personal data of Hilversummers. We process the data in both secure applications and in physical files that are stored in a secure manner. We only use (special) personal data when necessary. Information we use includes:

  • Name and address details and date of birth
  • BSN
  • contact details (phone number and email address)
  • address data
  • financial data (such as income and debts)
  • debt counseling results
  • other types of services
  • health data

Legal basis

We only use personal data if there is a basis for doing so.

Based on the law, the municipality has the task of supporting Hilversum residents with debts and to prevent Hilversum residents from taking on debts that they cannot pay.

It concerns Articles 2, 3, 8 and 9 of the Municipal Debt Assistance Act and the

Municipal Debt Assistance Decree (2021).

How long is personal data kept

We do not store personal data longer than necessary for the purposes described. This is for the duration of the debt assistance to be provided to you, unless a law requires us to keep data for a different period, such as the Archives Act 1995.

We must store data relating to debt assistance for at least 5 years.

Early detection

Personal data in the file relating to persons who do not want to cooperate in the early detection are not kept longer than necessary for the purposes, with a maximum period of 6 months. After this period, the data will be destroyed.

Change of this privacy statement

This is the privacy statement for the Social Square of the Municipality of Hilversum. This privacy statement is adjusted if the laws and regulations and/or the way in which we process personal data changes. This version was drawn up on June 11, 2021.
