Privacy statement (special) social assistance benefit

This privacy statement provides additional information about how the Social Square handles your personal data if you receive a (special) social assistance benefit. In addition, we explain to you what your rights are herein.

What do you need to know

Do you have too little money to make ends meet and can't earn enough yourself? Then you can apply for a social assistance benefit. This is possible, for example, if you are not entitled to another benefit or if you are still below social assistance level even with that other benefit. We call this the right to maintenance assistance.

In addition, you may have to incur costs due to special circumstances that you cannot pay yourself. You can then receive individual special assistance under certain conditions. We call this the right to assistance for exceptional costs.

The municipality uses personal data to facilitate the process of providing assistance for living expenses or for special costs.

For what purposes do we use personal data

The main objective is to assess the application and to pay out the assistance. We use different categories of personal data of the Hilversummer concerned for this purpose. This includes, for example, information about the applicant's partner, children and co-residents. We use your personal data for:

  • Assessing and determining the right to maintenance assistance and/or special assistance and the amount thereof
  • Conducting research into the financial position and available provisions and making a means calculation
  • Communicating and corresponding with the applicant, including sending the application form, requesting clarification of the application and sending the decision
  • Processing changes to the data that affect the right to maintenance or special assistance and being informed about this

What personal data do we use

The municipality of Hilversum uses different categories of personal data of the Hilversum residents involved. For example, we use name, address, citizen service number, financial information about your income, debts, assets and bank details. In some situations we use data about health if this is necessary for the payment of special assistance. In some cases we use criminal data, for example whether you are in detention. This has consequences for the right to a benefit.

Legal basis

According to the law, the municipality has the task of offering assistance to residents of Hilversum. This is for the residents who have no means to pay the necessary living expenses. In addition, according to the law, the municipality has the task of providing special assistance to residents who do not have the means to pay the necessary living expenses. We use personal data for these tasks. This is regulated in, among other things: 

  • Article 7, 35, 53a and 67 Participation Act
  • Article 62 Structure Implementation Organization Work and Income Act (Suwi Act)

Who receives the personal data

When this is necessary for the purposes described above, we share personal data with various parties. For example, by law we must share personal data with, for example, the UWV, the Tax and Customs Administration, health insurers and the information agency. We also share personal data with relevant care providers, partners and authorized representatives. We only do this if there is a legal basis for doing so.

How long do we keep the personal data

We do not store personal data longer than necessary for the purposes described. We must keep your data for 10 years, once the assistance to you has stopped. If you are refused assistance, we will keep your data for 5 years. We apply the Archives Act 1995.
