You want to have it officially recorded that the legal father is no longer the legal father. This is called denying paternity. This is possible under certain conditions.
What do you need to know
- If the father is not the father of the child and the mother has not been honest about this, then you can ask to reverse paternity. The father, mother and child can apply. You do this in court
- If the father died before the child was born, the mother can request to revoke paternity. There are conditions for this. You can do this at the municipality
What do you have to do
You must meet a number of conditions:
- You are the biological mother of your child
- Your child is not yet 1 year old
- Your husband or registered partner died in the 306 days before the birth of your child
- You were already separated from your partner during those 306 days. This can be either a divorce or a legal separation
- You did not yet have a new marriage partner or registered partner when your child was born
