Environment plan

The Environmental Act will apply from 1 January 2024. From this date, the municipality has an environmental plan with the municipal rules for the physical living environment. The environmental plan is the successor to, among other things, the zoning plans.

What do you need to know

  • The municipality will automatically have an environmental plan on January 1, 2024: it is called an environmental plan by operation of lawThis Environmental Plan is a temporary section. Amendment of environmental plan in procedure

The Hilversum Municipal Environmental Plan may not be adequate or sufficiently up-to-date. If this is the case, the plan must be amended. Amendments to the plan are made through a statutory process. Deviating from the environmental plan

Deviating from an environmental plan is different from deviating from a zoning plan. 

With a permit for one extra-plan environmental plan activity (BOPA) Deviations from the rules included in the Hilversum Municipal Environmental Plan are permitted. This applies to both minor and major deviations. For larger development sites, such as those for residential construction, the environmental plan itself is often amended. In the case of major deviations, a resident or business owner must decide how they intend to deviate from the environmental plan.   

Advisory right of the council  

Under the Environmental Act, the council is authorized to grant environmental permits for activities that fit within the environmental plan, but also for cases that do not fit within the environmental plan (the extra-plan environmental plan activity).
