Disadvantage compensation

If you suffer damage because, for example, the municipality changes something in the environmental plan, you may be entitled to compensation because that change is disadvantageous to you. For example, your house becomes less valuable due to the construction of a road.

What do you need to know

  • During the environmental plan states how an area may be used
  • Damage can occur if the municipality changes the environmental plan or deviates from the environmental plan or takes another decision that puts you at a financial disadvantage. For example: a house or a piece of land becomes less valuable because the municipality has a road built where this was not yet permitted
  • The entire process of receiving compensation can take a long time 

Terms & conditions

  • You must be able to prove that you have suffered damage
  • You must describe the nature of the damage and, if possible, the amount and specification of the damage
  • You request compensation within 5 years after:
    • an environmental permit has been granted for that change, or
    • if no environmental permit is required, a notification has been made or information has been given that the change is being carried out, or  
    • if the foregoing does not apply, from the actual start of the change (the work)  
  • You can prove that it is not fair if you have to pay the damage yourself
  • You could not have expected the damage, for example when you bought the house or the land
  • You have not received any other compensation (e.g. due to expropriation)
  • All rules for compensation are contained in the General Administrative Law Act (Title 4.5), the Environmental Act (Section 15.1) and the  Hilversum Disadvantage Compensation Regulation 2022

What do you have to do

  • You ask claim form via email

After your request

  • After submission you will receive a confirmation of receipt
  • If necessary, an independent advisor or an advisory committee will handle your application
  • Sometimes advice from an advisor is not necessary
  • The municipality, the advisor or the advisory committee can invite you to explain your application during a meeting
  • The municipality, the advisor or the advisory committee may visit the site
  • The municipality, the advisor or the advisory committee will assess your application and prepare a draft advice. You will receive a letter about this
  • You can respond to this advice in writing or verbally
  • The municipality, the advisor or the advisory committee draws up a final recommendation for the council
  • The Board makes a decision and takes the advice into account
  • You will receive a letter with the decision

To object

If you do not agree with the Board's decision regarding your application, you can to object.

What does it cost

€ 300 for processing your application. You will receive this amount back when you receive the compensation, or part of it.
