Environment plan

The Environmental Act will apply from 1 January 2024. From this date, the municipality has an environmental plan with the municipal rules for the physical living environment. The environmental plan is the successor to, among other things, the zoning plans.

What do you need to know

  • The municipality will automatically have an environmental plan on January 1, 2024: it is called an environmental plan by operation of law. This environmental plan is a temporary part. The municipality is gradually converting this part into a complete environmental plan, which will be ready by 2032 at the latest.   • The environmental plan is the successor to (among other things) zoning plans
  • In the coming years, a large number of rules from regulations, including part of the General Local Ordinance (APV), will be included in the environmental plan.
  • The environmental plan describes how and where construction may take place, but health and all kinds of environmental topics are also described in the environmental plan.
  • In the environmental plan, the municipality can choose whether or not to set rules, but it can also determine whether something requires a permit or whether there is a reporting obligation.

Submit plan  

If you are preparing a concrete plan, you can... environmental plan activity (OPA) to request. If the application does not fit within the environmental plan, you can submit an application Extra-Plan Environmental Plan Activity (BOPA) .  

Deviating from the environmental plan

Deviating from an environmental plan is different from deviating from a zoning plan. 

With a permit for one extra-plan environmental plan activity (BOPA) it is possible to deviate from the rules included in the environmental plan. This especially applies to larger deviations, such as residential development locations. In the event of major deviations, a resident or entrepreneur must make a choice about how he or she wants to deviate from the environmental plan.  

Advisory right of the council  

Under the Environmental Act, the council is authorized to grant environmental permits for activities that fit within the environmental plan, but also for cases that do not fit within the environmental plan (the extra-plan environmental plan activity). For the extra-plan environmental plan activity, the municipal council has designated cases in which a binding advice from the council is required to deviate from the environmental plan.
